NABBER SYSTEMS INC. Terms of Service Effective Date: May 22, 2026
These Terms of Service ("Terms") govern your purchase and use of products sold by Nabber Systems Inc. ("Nabber Systems", "we", "us", or "our"), a British Columbia corporation, through our website and online store. By placing an order or using our website, you agree to these Terms. If you do not agree, do not use our site or purchase our products.
1. About Our Products
Nabber Systems Inc. designs and manufactures autonomous mechanical rodent control devices, including the Nabber Mini and Nabber Multi product lines. Our devices are intended for use in controlling rodent populations (mice and rats) without the use of rodenticides. Our products are patented in multiple jurisdictions.
Our products are sold for use in Canada and the United States. It is your responsibility to ensure the products are used in compliance with applicable local, provincial, state, and federal laws and regulations in your jurisdiction, including any licensing requirements applicable to pest control operators.
2. Eligibility
By purchasing from us, you represent that you are at least 18 years of age; you are purchasing for lawful purposes; you have the authority to enter into a binding agreement; and your use of our products will comply with all applicable laws and regulations.
3. Orders and Payment
All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order for any reason, including product unavailability, suspected fraud, or errors in product or pricing information.
Prices are listed in Canadian dollars (CAD) unless otherwise indicated. For US customers, currency conversion and any applicable exchange fees are the responsibility of the purchaser and will be handled through your payment processor at the time of transaction.
We accept payment methods as listed at checkout. Payment must be received in full before orders are processed and shipped.
4. Shipping and Delivery
We ship to addresses in Canada and the United States. Shipping times are estimates and are not guaranteed. We are not responsible for delays caused by carriers, customs processing, or circumstances outside our control.
Risk of loss and title for products pass to you upon delivery to the carrier. You are responsible for providing accurate shipping information; we are not liable for orders delivered to an incorrect address provided by you.
For US shipments, you may be responsible for applicable import duties, taxes, or customs fees. These are your responsibility and are not included in our product pricing.
5. Returns and Warranty
5.1 Return Policy
We do not accept returns for change of mind or buyer's remorse. All sales are final except as provided under our warranty policy below.
5.2 Limited Warranty
Nabber Systems Inc. warrants that its products will be free from defects in materials and workmanship under normal use for a period of twelve (12) months from the date of original purchase ("Warranty Period").
If a product proves defective during the Warranty Period, we will, at our sole discretion, repair or replace the defective product, or issue a credit toward a future purchase. This warranty is your exclusive remedy for product defects.
5.3 Warranty Exclusions
This warranty does not cover: damage resulting from misuse, abuse, neglect, or accident; damage from failure to follow product instructions or recommended maintenance; damage from unauthorized modification or repair; normal wear and tear; or consumable components.
5.4 Warranty Claims
To make a warranty claim, contact us at info@nabbertraps.com with your order number, a description of the defect, and photographic evidence where applicable. We will review your claim and respond within ten (10) business days.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NABBER SYSTEMS INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, PROPERTY DAMAGE, OR PERSONAL INJURY, ARISING OUT OF OR RELATED TO YOUR USE OF OUR PRODUCTS OR WEBSITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR PURCHASE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.
7. Disclaimer of Warranties
EXCEPT AS EXPRESSLY SET FORTH IN SECTION 5, OUR PRODUCTS AND WEBSITE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that our products will achieve any specific result in rodent control. Effectiveness may vary depending on environmental conditions, rodent species and population density, installation, placement, and maintenance practices.
8. Intellectual Property
All content on our website, including product designs, text, images, logos, and trademarks, is the property of Nabber Systems Inc. or its licensors and is protected by applicable intellectual property laws. Our products are protected by patents in multiple jurisdictions.
You may not reproduce, distribute, modify, or create derivative works from our content without our prior written consent.
9. Regulatory Compliance
Our products are designed and registered for use in Canada and the United States. You are responsible for determining whether our products are approved for use in your specific jurisdiction and for obtaining any required permits or licences. We make no representation that our products are approved or suitable for use in jurisdictions outside Canada and the United States.
10. Privacy
Your use of our website and the collection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our website and purchasing our products, you consent to the collection and use of your information as described in the Privacy Policy.
11. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Any dispute arising out of or relating to these Terms or your purchase shall be resolved by the courts of competent jurisdiction in the Province of British Columbia. For US customers, you consent to the exclusive jurisdiction of such courts for the resolution of any dispute.
12. Changes to These Terms
We reserve the right to update or modify these Terms at any time. Changes will be effective upon posting to our website with an updated effective date. Your continued purchase or use of our products after any modification constitutes your acceptance of the revised Terms.
